  • Banter yes; hate, threats, harassment and spam no: those who go too far are sanctioned.
  • Game points, credits and rewards are virtual: no money, no cash prizes.
  • Sports data may contain errors or delays.
  • You can leave whenever you want by deleting your account.

1. The service and who runs it

GoalingBreak is a free football platform, on goalingbreak.com and in the iOS and Android apps. It offers live scores, fixtures, standings, statistics and news; the team community (“the Curva”), SocialBreak and voice rooms; quizzes, FantaBreak and other games; an assistant; notifications about the matches and teams you follow.

2. Acceptance and related documents

By using GoalingBreak you accept these Terms. If you create an account, the Terms are the contract between you and Wayku SL. The Privacy Policy, the Cookie Policy and, for those who join the partner programme, the partner programme conditions are also part of the rules.

The Terms are available in Italian and English; people using the service in another language see the English version. You can read them at any time on this page.

3. Minimum age

To create an account and use the community features you must be at least 16 years old. By signing up you confirm that you are. If we find out an account belongs to someone younger, we close it.

4. Your account

  • One account per person, with true information; no shared or transferred accounts.
  • Keep your credentials safe: you are responsible for what happens with your account. If you think someone else is using it, change your password and write to us.
  • If you log in with Google, Apple or Telegram, their terms apply as well; we only receive the data described in the Privacy Policy. If an account with the same verified email already exists, signing in with Google or Apple opens that account.
  • In the app, notifications about the teams and matches you follow arrive even without an account, if you allow them on your phone; when you create an account or log in, the phone moves to your account.
  • Your username and profile photo are public: no offensive, vulgar or misleading names or images, and no impersonation of clubs, players, public figures, other people or our staff. We may change a username that breaks these rules.

5. Community rules

The Curva, SocialBreak, comments, voice messages, polls and voice rooms are for cheering, discussing and banter. Football banter is welcome; personal attacks are not. You may not post, say or share:

  • illegal content or content inciting crime;
  • hate, discrimination or insults based on origin, nationality, religion, gender, sexual orientation, disability or other personal characteristics, including discriminatory chants and symbols;
  • threats or incitement to violence, including between fan groups;
  • harassment, stalking, bullying;
  • nudity, explicit sexual or violent content; any content sexualising minors;
  • other people’s personal data (addresses, phone numbers, documents, private photos) without their consent;
  • recordings of voice rooms or of other people’s voices made or shared without the speakers’ consent;
  • links to pirated match streams or other content infringing copyright, trademarks or other rights;
  • spam, chain messages, advertising or promotion of third-party products, services or sites;
  • scams, misleading links, malware;
  • impersonating others or presenting false information as true to deceive people.

Using multiple accounts to gain an advantage in games or rankings, bots, bulk data extraction from the platform and any attempt to get around technical limits or sanctions are also forbidden.

You are responsible for what you post and for what you say in voice rooms. Voice rooms are live: we do not record them.

6. Reports, moderation and sanctions

Reporting

You can report posts, comments, profile photos and behaviour in voice rooms with the report button, or by writing to info@goalingbreak.com. To report content you believe is illegal, tell us where it is (the link), why it is illegal, your name and email, and confirm that the report is made in good faith. This address is also our point of contact for users and authorities under Regulation (EU) 2022/2065 on digital services; you can write to us in Italian, English or Spanish.

How we moderate

Profile photos first go through an automated check (see the Privacy Policy). In the “For you” feed, a post that receives 2 or more reports is automatically taken down until a moderator decides. Reports are reviewed by our team: the final decision on removals and suspensions is taken by a person on the team or, in the curva, by the Leaders with the powers described below.

Curva ranks and powers

Ranks are earned by taking part and give some powers in your own team’s curva: for example pinning a post, creating polls, rallying the curva with a notification, muting someone or removing them from the voice room. These powers are meant to keep the curva a good place, not to target people who support differently: anyone who abuses them loses them.

Sanctions

If a rule is broken, depending on how serious and repeated it is, we may:

  • hide or remove the content;
  • limit the visibility of your content;
  • remove your profile photo or stop you from uploading new ones;
  • mute you or remove you from a voice room;
  • take away powers, ranks, points or progress obtained unfairly;
  • suspend your account or close it permanently.

Every moderation decision that concerns you is communicated to you with the reason and the option to challenge it, from the “Decisions” page of your account or by replying to the email you receive. Deceptive commercial spam and cases where the law does not allow it are the exception. A challenge is reviewed by a different person from the one who took the decision, where possible.

7. Your content

What you post remains yours. By posting it you grant Wayku SL a non-exclusive, royalty-free, worldwide licence, transferable to the providers that help us run the service, to host, display, reproduce and technically adapt it (for example resizing a photo or converting audio) within GoalingBreak and in previews when someone shares it.

The licence ends when you delete the content or your account, except for copies other users have already shared and for backups, which are deleted in their technical timeframes.

You confirm you hold the rights to what you post (text, photos, audio) and that it does not infringe anyone else’s rights.

8. Games, points and rankings

Quizzes, the daily quiz, FantaBreak, challenges and the other games are free and offer no cash prizes or prizes of economic value. Curva points, XP, FantaBreak credits, ranks, trophies, streaks, passes and rankings are game elements: they have no monetary value and cannot be converted, sold, transferred or refunded.

We may change game rules, rebalance scores and virtual rewards and correct wrong results caused by technical errors. If you use multiple accounts, automation, system errors or invite manipulation, we may reset the progress involved or close the account.

9. Invites and partner programme

Invites

An invite link credits the new user to the inviter: the first link opened counts, for 90 days. An invite only counts if the new account is real and has a confirmed email. Invite rewards are virtual only (for example points, XP, trophies). We may withhold or cancel rewards obtained through suspicious invites.

Partner programme

The partner programme is open to people we approve. Partners earn commissions on sign-ups and purchases made in the linked services of the same company by the users they brought. Commissions, thresholds, payout methods and duration are governed by the conditions communicated to the partner when joining, which prevail over these Terms for everything concerning the programme.

Anyone promoting GoalingBreak must comply with advertising and commercial communication law: no spam, no misleading messages or earnings claims, no promotion aimed at minors, and they must clearly disclose that the content earns commissions. Sign-ups and installations obtained unfairly do not earn commissions.

10. Sports data, news and other content

Scores, statistics, line-ups, fixtures, transfers and news are provided “as is”, for information and entertainment only. We work to keep them correct and up to date, but they may contain errors, omissions or delays, including during live matches, and we do not guarantee that they are accurate, complete or timely. Official communications from clubs and competitions always prevail.

News items link to the articles of their publishers, who are responsible for them.

GoalingBreak is not a betting service: it does not accept bets and does not handle users’ money. Any third-party operator information is shown for information only and is reserved for adults.

11. Promotional communications

GoalingBreak is free partly thanks to promotions of other Wayku SL services and of any commercial partners, which we show on the platform, in notifications and in emails, always marked as sponsored content. You can stop promotional emails from the link at the bottom of every email.

12. Third-party links and services

The platform contains links to other people’s sites and services (publishers, app stores, social networks, Telegram services, club websites). We do not control them and are not responsible for their content or privacy practices: when you use them, their terms apply.

13. Intellectual property

The GoalingBreak brand, logos, artwork, editorial texts, software and databases of the platform belong to Wayku SL or its licensors. You may use them only for your personal use of the service.

Without our written consent you may not copy, systematically extract (including with automated tools), republish or reuse the platform’s data and content, embed it in other sites or reverse-engineer its software.

Names, crests and logos of teams and competitions belong to their respective owners and are used for identification only. If you believe content infringes your rights, write to info@goalingbreak.com.

14. Availability and changes to the service

We do our best to keep GoalingBreak working at all times, but we cannot guarantee it will be available without interruptions or errors: maintenance, outages or problems with external providers may slow it down or stop it. We may add, change or remove features; if we remove an important feature we will tell you in advance, where possible.

15. Liability

The service is free. To the extent permitted by law, Wayku SL is not liable for indirect damage, for decisions taken on the basis of data or content on the platform, for content posted by users, or for third-party services and sites.

Nothing in these Terms limits our liability for wilful misconduct or gross negligence, for death or personal injury, or the rights that the law grants consumers on a mandatory basis.

You are liable for damage you cause to Wayku SL or others by breaking these Terms or the law.

16. Duration, withdrawal, suspension and termination

The contract has no fixed term. You can withdraw whenever you want, free of charge and without giving reasons, by deleting your account from the Account page on the website or from Profile in the app (see Delete your account): this also covers the 14-day right of withdrawal granted to consumers.

We may suspend or close an account that seriously or repeatedly breaks these Terms or the law, as described in the moderation section. We may also close the service, giving reasonable notice.

17. Changes to the Terms

We may update these Terms when the service or the law changes. We will tell you about significant changes at least 15 days before they take effect, on the platform or by email. If you disagree you can delete your account before that date; if you keep using the service afterwards, the new Terms apply.

18. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer living in another European Union country, you keep the protection of the mandatory rules of your country and can bring proceedings before the courts where you live.

For users who are not consumers, the courts of the controller’s seat in Spain have jurisdiction.

Before going to court, write to us: we will try to sort it out. You can also contact the consumer authorities and associations of your country.
